Terms of Use — Nutrea

These Terms of Use ("Terms") govern your access to and use of the Nutrea website and mobile application (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Eligibility & Account

You must be 16+ (or the age of majority where you live). If under 16, you need a parent/guardian's consent and supervision. Keep your account information accurate and your credentials secure. You are responsible for all activity under your account.

2) Health & Safety Notice

Nutrea does not provide medical advice, diagnosis, or treatment. Always seek a qualified professional's advice for health questions. In emergencies, call local emergency services. You are responsible for your own choices.

3) Permitted Use

Do not misuse the Services (no illegal activities, harmful/defamatory/infringing content, data scraping, reverse engineering, or interference with security). We may suspend or terminate access for violations.

4) Your Content

You retain ownership of content you submit (e.g., meal photos, notes, metrics). You grant Nutrea a non-exclusive, worldwide, royalty-free licence to host, process, and display that content only to operate and improve the Services and as described in our Privacy Policy.

5) Fees, Subscriptions, Trials (if applicable)

Some features require payment (e.g., subscriptions). Prices are shown before purchase and may include VAT. Mobile purchases are processed by Apple App Store/Google Play under their terms. Subscriptions auto-renew unless cancelled ≥24h before the current period ends. Cancel in your App Store/Google Play account settings. Refunds for in-app purchases are handled by the store. If you buy directly from Nutrea (website), contact contact@foodways.be. Your statutory consumer rights remain unaffected.

EU withdrawal right: for digital services delivered immediately, you may be asked to consent to immediate performance and acknowledge losing the 14-day withdrawal right.

6) Privacy

Our Privacy Policy explains how we process personal data, including any health data processed only with your explicit consent. Manage consent and device permissions (camera/photos/notifications) in your settings.

7) Intellectual Property

The Services (software, design, text, graphics, trademarks, etc.) are owned by Nutrea or its licensors. No rights are granted except those needed to use the Services as intended.

8) Changes to the Services/Terms

We may update features or these Terms at any time. We will post changes and update the "Last updated" date; material changes will be reasonably notified. Your continued use means acceptance.

9) Termination

You may stop using the Services or delete your account at any time (see Privacy Policy). We may suspend or terminate your access for breach, legal requirements, or service discontinuation. Certain sections survive termination (e.g., 4, 7, 10–12).

10) Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties (including fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability).

11) Liability

Nothing in these Terms excludes liability that cannot be excluded by law (including death/personal injury caused by negligence, fraud, or gross negligence/wilful misconduct). Otherwise, Nutrea is not liable for indirect or consequential losses (e.g., lost profits, data, goodwill). Subject to the foregoing, our total liability for all claims is limited to the amounts you paid to Nutrea in the 12 months before the event (or €50 if none), unless mandatory law provides otherwise.

12) Third-Party Services & App Stores

We may link to or integrate third-party services; their terms and privacy policies apply. Apple and Google are not parties to these Terms and have no responsibility for the App.

13) Governing Law & Disputes

These Terms are governed by the laws of Belgium. Courts of Brussels have jurisdiction, without prejudice to mandatory consumer protections. EU consumers may use the ODR platform: https://ec.europa.eu/consumers/odr.
